Agreement to Terms

Welcome to The Habit of Writing, operated by The Habit Of Writing Ltd ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

The Service

The Habit of Writing helps people build a consistent writing habit by providing digital tools to write, reflect, and track progress. We provide the platform and technology, and you provide the words. You must be at least 13 years old, or the minimum age of digital consent in your country, to use the Service. We reserve the right to suspend or terminate accounts that violate these Terms, misuse the platform, or remain inactive for long periods.

Your Account

You are responsible for all activity under your account and for keeping your login credentials secure. We are not liable for any loss or damage resulting from unauthorized access to your account. We may access or review account data when required by law or when necessary to maintain system integrity and enforce these Terms.

Content Ownership and License

You own the rights to the writing and content you create within The Habit of Writing. By using the Service, you grant The Habit Of Writing Ltd a worldwide, royalty-free, perpetual, and transferable license to store, process, and display your content for use within your account, to back it up securely, and to analyze or use aggregated, anonymized, or de-identified data such as word counts, streaks, or usage metrics to improve and promote the Service.

We will never publicly share or sell your individual writing without your explicit consent. If you delete your account, your content will be removed from active systems within a reasonable period, although anonymized or backup copies may be retained for operational, analytical, or legal reasons.

AI Features

Some parts of the Service may use artificial intelligence to provide writing insights, summaries, or reflections. By using these features, you acknowledge that AI-generated content is created automatically and may not always be accurate or appropriate, and that you are solely responsible for how you use or rely on it. The Habit Of Writing Ltd makes no warranties regarding the accuracy or reliability of AI outputs.

We may use anonymized or aggregated user data to train, refine, or improve AI systems, including those operated by third-party providers such as OpenAI or Anthropic. You retain ownership of your original writing, while AI-generated text may be partially owned or licensed by The Habit Of Writing Ltd or its providers, depending on the technology used.

Subscriptions and Payments

Some features require a paid subscription. When you start a free trial, billing begins automatically at the end of the trial unless you cancel beforehand. Payments are processed securely by third-party partners such as Paddle, Stripe, Apple, or Google. You are responsible for ensuring your payment information is valid and up to date.

All payments are non-refundable unless required by law. We may, at our sole discretion, issue credits or partial refunds but are not obligated to do so. We reserve the right to change pricing, plans, or features at any time, and continued use of the Service after changes take effect means you accept the new terms.

Service Availability and Changes

We aim to provide reliable, continuous access but cannot guarantee uninterrupted operation. We may add, modify, or remove features at any time without notice, including AI functionality, and we are not responsible for any loss of data or productivity caused by downtime or changes to the Service.

Privacy and Data Usage

We collect and store the data needed to operate and improve The Habit of Writing, including account details, writing entries, usage metrics, and device information. By using the Service, you consent to this data being processed and stored, which may include transfer to servers in other countries. Anonymized data may be used for analytics, research, or service improvement. We may contact you by email or in-app messages about your account, updates, or new features.

Intellectual Property

All software, design, and intellectual property associated with The Habit of Writing belong to The Habit Of Writing Ltd. You may not copy, reverse-engineer, or redistribute any part of the Service without written permission.

Account Termination

You may delete your account at any time. We may suspend or terminate your access if you violate these Terms or harm other users or our business. Deleted accounts will have associated content removed from active systems within a reasonable period, though anonymized or backup data may remain for legitimate purposes.

Disclaimer of Warranties and Limitation of Liability

The Service, including AI features, is provided "as is" and "as available." We make no warranties about reliability, accuracy, or fitness for any purpose. You use the Service at your own risk.

To the maximum extent permitted by law, The Habit Of Writing Ltd is not liable for indirect, consequential, or incidental damages, for any loss of data or productivity, or for reliance on AI-generated or user-submitted content. Our total liability for any claim will not exceed the amount you paid us in the preceding 12 months.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
